Omaha Real Estate Horror Story: Incompetent Agent Starves Buyer to Death
This tale comes to us from long ago in the fast-paced and long forgotten Omaha real estate market of 2005.
It was closing day. I got a call just after closing from my sellers. The seller asked me, "Were we suppose to leave the refrigerator?" I told him, "No, the buyer didn't ask for it in the purchase agreement so it's yours to take." I asked why he was asking. Apparently what had happened was as the sellers were finishing loading their moving truck the buyer showed up to start moving in, and he expected the refrigerator to stay. The seller said he would explain what I had told him to the buyer.
A few minutes later I got a call from the buyer's agent. He said that the buyer was planning on the sellers leaving the refrigerator. I told him that since it had not been asked for in the contract that the sellers were taking it. To this he replied, "But it was listed in the MLS." I explained that my clients accepted the price the buyer had offered because the buyer was not asking for the refrigerator. Had the buyer asked for the frig then my sellers would have needed a higher price so that they could afford to buy a new one.
Any agent should know that what is advertised with a home is not part of the sale unless it is included in the contract.
End result? As a result of this agent's incompetence the buyer moved into a house with no way of keeping his food from going bad. He soon withered away and died. Okay, maybe he didn't die but he was probably hungry and very disappointed in his agent's lack of skill.
What should have happened in this situation? The agent should have admitted his mistake and bought his client a refrigerator.
